Terminology
Any reference to us/we/vendor/business/seller shall mean MaxSpec Engineering.
Any reference to buyer/purchaser/customer/you shall mean any person, sole trader, partnership, business, body corporate or other entity that visits this site or is detailed in the appropriate section of the sales invoice/order form.
Goods shall mean the items detailed in the appropriate section of the quote, order form or invoice.
“Working day” shall mean any day excluding Saturdays, Sundays and public holidays.
Overview
By visiting this site and/or by purchasing goods and/or services from us, you agree to be bound by the following terms & conditions and policies linked therein. These conditions shall apply to all of the businesses quotations, contracts & orders for the sale or supply of goods accepted by the business.
The business reserves the right to amend technical or clerical errors in any order without notice. In addition, the buyer shall ensure that all details contained within the order are correct and no liability for any error or inaccuracy shall lie with the business.
We reserve the right to refuse goods/services to anyone for any reason at any time.
Products
We may modify, discontinue or change prices for our goods and/or services at any time without notice unless previously agreed in a valid written quote/invoice.
Despite our best efforts, products images listed on our website may appear slightly different in person due to lighting and screen differences
Our hand made parts will have subtle differences to each other and may not match exactly the images on the products listing.
Limitations of liability
Advice given by this business is based entirely upon information given by the purchaser. Where advice is given after visual inspection by this business, such advice shall amount to an opinion only and the business shall not accept liability for any inaccuracies. Additionally, goods supplied are supplied only to correspond to the purpose for which they are designed and not alternative uses. No liability for failure can be accepted by this business for such alternative use, amendment or modification.
Where goods purchased by the buyer are alleged to be defective, the purchaser agrees to return such goods to the seller for inspection and report (without the seller replacing the said goods prior to such inspection). The goods must be packaged properly and returned in an otherwise good condition so that a proper inspection can be made. The purchaser further confirms that it shall be reasonable for the seller to repair or replace (at its discretion) such defective goods. The purchaser also accepts that it must inform the seller of any interruption, defect or other failure to allow the seller to offer a remedy prior to contacting independent third parties or incurring expense. Parts modified, adapted or poorly maintained by the purchaser, including incorrectly supplied or defective parts, shall no longer be warranted by the seller nor shall the seller be liable for any failures, injury or death unless caused by it’s own negligence.
Risk and responsibility to the goods passes to the buyer on delivery such that the seller will not be responsible for any loss, damage, injury or death unless as a direct result of the sellers negligence.
The seller accepts no liability for consequential loss or damage to other property not supplied by the seller, which is attributed to the fault or failure of the goods supplied. The seller’s liability for any damage/failure of goods supplied shall be limited to the invoice total.
“Competition” goods are supplied for specialist use and are subject to extreme wear and stress whilst in use. Life expectancy and durability are greatly reduced in this environment and purchasers should note that any claim for failure/wear shall be limited to that of the relevant section in the sellers guarantees. In addition, parts connected to parts supplied by this company may be placed under stress where specialist/competition parts are used, and purchasers should take advice from experts prior to purchase and installation.
The seller accepts no liability in respect of failure or delay to supply or fulfil any agreements or contracts caused by matters beyond the reasonable control of the seller, including but not limited to strikes, lockouts, civil disputes, acts of God, war, disease, illness, flooding, fire or actions by third parties.
Title and delivery
All times given for dispatch or delivery are approximate and time shall not be of the essence.
The buyer is required to notify the business, in writing, of any shortage or other discrepancy within 3 working days of such incident, or 5 working days in the case of miss delivery, thereafter the buyer shall be liable for any such discrepancy. Where delivery is affected to the buyers own delivery contractor, the seller shall not be liable for any loss or damage in transit and claims should be made directly to the carrier. The seller may assist the purchaser in making their claim at their discretion.
The buyer confirms that he shall comply with any or all rules relating to installation of the product concerned and fully accepts that any loss which results from forced, misdirected, inappropriate or unqualified installation shall not be accepted by the company.
Please note that for items ordered from MaxSpec Engineering, your contract to purchase these items is not complete until we receive payment in full and notify you that the items have been dispatched to you. We reserve the right to cancel any order for any reason. Possible reasons for cancellation include, but are not limited to the following:
A. Potentially fraudulent order
B. Incorrect pricing
C. Incorrect delivery address provided
Photos and reviews
If you submit photos, comments and/or reviews with or without our request, whether online, by email, by post, by phone, or otherwise, you agree that we may, at any time, without restriction, edit, copy, publish, distribute or otherwise use them in our publications.
